In April 2008, while unloading empty wine bottles from the Gregory’s delivery truck, the tail lift malfunctioned and the load fell on Mr. George Musgrave, the owner of the Polmassick vineyard at St. Ewe, near St. Austell.

The HSE sued this company. Gregory Distribution Ltd pleaded guilty to charges of violating Section3 (1) of the Health and Safety Work Act. The violation committed was that the company had exposed the customer to risk by failing to make adequate arrangements for unloading the trucks. The court fined the Gregory Distribution Ltd £200, 000. An additional amount of £ 16, 993 was added as costs to this fine.

In the BBC report the company expressed its regret about the accident. They also said that they were taking steps to prevent such accidents from taking place.

Mr. Jones expresses the opinion that regular maintenance checks of the tail spin would have prevented such a mishap from taking place. Like the saying goes “A stitch in time saves nine”. Similarly the right safety measures taken at the right time prevent half the problems.

Minister Advises Councils on World Cup Flag Flying Issue

Reports say that Local Government Minister Grant Shapps has advised council heads across the United Kingdom to take a sensible approach over possible health and safety concerns with regard to the public’s flag flying antics in demonstration of their support for the national football team at the 2010 World Cup.

Shapps, in his letter, wrote that it is important that decisions on safety and health are based on proper risk assessment and the councils have the authority to take suitable local decisions.

According to reports, York and Lancashire councils had forbidden flag-flying in their jurisdiction.

The government’s advice to the local councils was welcomed by Policy and Technical Director at the Institution of Occupational Safety and Health (IOSH) Richard Jones. The institution felt validated as it had been campaigning for a common-sense approach to public health and safety for years. Jones said that local councils should not fear taking unpopular decisions and place public safety and health concerns first.

Jones added that the IOSH supported Shapps’s suggestion to local authorities and hoped that this advice would promote a practical approach to public health and safety issues. He also said that the institution was happy to assist the new government in the ongoing process.
